Multi-Million Settlement

Tom's life was cut short, violently and without warning. He was working late at his business in Kansas City and nearby, KPL Gas Service was working on a gas main. Shortly before Tom was due to leave work, a leak from the gas main caused a massive explosion which demolished almost a full city block and took Tom’s life in the process. Suit was filed in Federal Court in Kansas City. After 2 ½ days of trial, the defendants settled for a confidential amount that was substantially higher than the pre-trial demand.

$1.25 Million verdict

Mr. Jeames Shope was 94 years of age, frail and weak, and suffered from dementia. Mr. Shope lived in a nursing home and, during one of their regular visits, his family noticed that he was bruised in several places. Our investigation revealed that the nursing home had assigned an unlicensed CNA with a prior criminal record to "care" for Mr. Shope on several occasions. Mr. Shope died from unrelated causes before trial. There was no offer of settlement but after a week-long trial, the jury returned a verdict of $1,250,000. The Defendant appealed to the Arkansas Supreme Court but after the parties' oral arguments, the defense settled for the full amount of the verdict plus interest.

Confidential Settlement - Construction Fraud

Our client created a commercial real estate development in Clay County, Missouri which was completed in phases over a 5-year span of time. There were five buildings in the development, all of which had asphalt parking lots. More than five years after completion of the last phase of the project, one of the parking lots broke up and required extensive repair work. During the repair, it was discovered that the asphalt in all of the lots was much thinner than was called for in the contracts. Suit was filed alleging fraudulent concealment of the defective and non-compliant asphalt work. The Defendant alleged that the claims were barred by the five-year statute of limitations. On the brink of trial, after several rounds of legal briefing, the case settled for a confidential sum with which our client was well-satisfied.
